Ted Olsen explains the Constitutional case for gay marriage
I think Ted Olsen does a superb job at explaining the Constitutional case for gay marriage in his interview with Chris Wallace. I recommend watching the video. The case for gay marriage is extremely well grounded in the Constitution.

It is a logical fallacy.

Olson does lay out the arguments very well.
I always thought that marriage inequality would be found to violate equal protection under the law (eventually).

Marriage goes way way way way beyond a union of two people. It affect taxation, inheritance, insurance, wealth, etc. It is simply IMPOSSIBLE to have a system where one subset of the population is subject to reduced rights and be equal under the law.

I can choose not to speak but I still have a right to speech.

One COULD make an argument that the govt should provide no support for marriage (all taxation based on single status, insurance only for your self, all inheritance taxed fully, no special rights for spouses, etc) however that isn't the argument made by Prop 8 folks.

They like all the special privileges granted to married couples. They simply want to deny them to a subset of the population.

7. Read my post #6. I felt the same as you do, but I've changed
my mind. For many years I've heard attorneys say they represent their client but do not necessarily agree with them. Ithink this is proof of that.

However unlikely, I praise Ted Olson for this.

I still condemn him for Bush v. Gore.

And that's okay.

LBJ got the Civil Rights Act passed, but he also failed miserably in Viet Nam.

This kind of reminds me of that.

6. I've changed my mind about Ted Olsen. I detested his client
back in 2000 and I applied my hate to his lawyer, and I was wrong. He really IS a very good atty and whoever made the decision to hire Olsen & Boyce to fight this case for them made a brilliant decision.

I wish there was a transcript of the actual trial posted somehwere. I'd ove to read it.

And so much seething disgust for the whole affair that the hatred for him extended even to his wife Barbara who had a show on Fox I was told.

Now, I look at Ted Olson on this segment on Fox and it is like I am looking at a different person from the one I imagined him to be 10 years back. What a hero he must have been to Fox viewers back then. And what must they think of him now?
