U.S. Senate Republicans Derail Judge Chatigny's Appeals Court Nomination

Judge Robert Neil Chatigny, U.S. District Judge for the District of Connecticut
Former nominee for the United States Court of Appeals for the Second Circuit
58 years old

U.S. Senate Republicans have derailed President Obama's nomination of Hartford district judge Robert N. Chatigny to the federal appeals court, likely postponing the controversial appointment to next year when partisan opposition is expected to grow.

The Senate's minority Republicans invoked a procedural rule which has the effect of removing Chatigny's nomination from the Senate - where it had not reached a final vote - and returning it to the White House.

Observers said Obama is likely to renominate Chatigny after the Senate's summer recess. But they said the Judiciary committee is unlikely to act upon the nomination, for what would be a second time, until after what is expected to be an increasingly Republican Senate is convened following the November election.

I disagree with that last statement the Judiciary likely will have him up again. Senator Reid will be the problem as he continues to refuse to use cloture on judicial nominees.

2. Yes, he can. BUT....
Recess appointments might not the best strategy at the moment.
I think Obama shouldn't make recess appointments this year for the federal judges because any recess appointments made now would expire when the next congressional session starts in January - five months from now.
The best thing to do would be wait until the first recess AFTER the first of next year, then the appointments would last closer to two years (until the end of that next session).
Note: even nominees that are appointed during recess must be eventually confirmed by the senate in order to make them permanent - so recess appointments are not a final solution.
Also, it would NOT be fair to ask the nominees to give up their current jobs this year in order to take a recess appointment that would only last less than five months.
