2. this is an area of considerable dispute
Some scholars argue that only an adjournment sine die at the end of a session of Congress can set the stage for a pocket veto. However, there is precedent supporting the use of a pocket veto where Congress is out on a recess of more than just a few days. Further confusing matters is that Congress sometimes designates someone to receive veto messages while on recess in order to prevent pooket vetoes. In those instances, Presidents sometimes say that they are pocket vetoing a bill, but also "return" the bill to Congress. The significance is that a pocket vetoed bill can't be overriden, while a regular veto can. Haven't seen the President's veto message so I don't know exactly what is being done with regard to 3808

5. From what I read, the Congress did adjourn...
even is someone is gaveling to keep Obama from recess appointments, because it cannot do any work to overried a Veto which needs Congress and the Senate in full session. I suspect it will not go into affect unless Congress wishes to take this pocket veto to the SCOTUS to adjudicate. This has been done in the past. This will be Obama's second pocket veto.
