Framingham, Mass. man facing charges for tossing toilet paper roll

FRAMINGHAM - A Framingham man is facing an assault charge for allegedly hitting a town hall custodian on the back of the head with a roll of toilet paper he threw because he was angry the man was whistling while he worked.

Framingham police say 55-year-old Allen Kerner was in town hall Wednesday using the bathroom. The custodian, not realizing anyone was in the restroom, whistled as he replenished the toilet paper rolls.

The custodian told police he was in a stall when struck. Kerner yelled at him about whistling and fled. Kerner, pursued by the custodian, was apprehended by police outside.

Police tell The MetroWest Daily News that Kerner will be summoned to court to face an assault and battery charge. A number for Kerner could not immediately be located.

Seriously?

You want to know why our jails and prisons are overcrowded? You want to know why we have the funds to build more jails and prisons?

We're overcriminalized, and this is a perfect example of how.

9. AND hard as a rock.
Some of the larger ones I have seen are not only huge, but the sheets are so flat and wrapped so tight, it forms a rock hard possible bludgeoning instrument. I really would consider those types to be possibly dangerous.

11. Yes, seriously. Even throwing wet noodles on someone can be assault and battery.
The assault doesn't need to leave a mark.

As to why this lead to an arrest, perhaps there's more to the story that just the hurling of the TP roll.

10. Sounds ridiculous but it really is assault and battery. The only distinction
between toilet paper and a brick is the degree of the charge. The brick is assault with a deadly weapon--that's the only difference here.
