You CAN'T accidentally delete 5 MILLION emails
Last time I checked, destroying subpoenaed things was a CRIME.

Why is this not being more aggressively pursued?

3. Yes you can, if you own or control the server, which RNC did do. Example,
I think you'll agree, Yahoo can delete mail on its server. The RNC could delete its mail and did.

It was illegal for Rove and the gang to be using a non white house server for gov transactions. They are probably in some Swiss bank vault by now and will be hauled out whenever * needs a few bucks for a book around 2012. IMO.

6. Agent based destruction
companies use features in domino and exchange that automatically archive and destroy data. It must comply with written policy. IE you cant just change it on the fly.

You can set these tools to stop a user from archiving their own files.

There is a difference in deletion and destruction.

9. Its more difficult than you think
Particularly considering server backups and the ability to recover data from harddrives. In order to make 5 million+ emails disappear and not be recoverable you have to put quite a bit of effort into it.

11. Its fairly easy to set up a system the is immune to forensic recovery
and simply doesn't save things over a certain date and does not archive.

How this can be done was pretty well thrashed out some time ago

That is not how things are done on a regular basis. To suggest that 5 million emails met their end due to a selfdestruct button that just accidently happened to be set up on this collection of data is stretching creduality.

15. Oh yes you can.. the question is why can't you get them back after the delete ?
I've made worse mistakes in my career, but you know what... I have always been able to "restore" the data after an accidental delete. Granted this has only happened two times in a 25year career but still.... the number were larger (in terms of records deleted) and yet... We were able to recover. Good thing too, it would have been my ass had we not.

I'm just sayin'
