I have a question
How does it work when a case is appealed by the loser? A higher court hears the appeal to determine if the Judge's ruling is correct? Or does it go to an appellate court? In the DADT case that's being appealed by the DOJ, what would have to happen for the case to advance to a higher court, ultimately the Supreme Court? Would the higher court/appellate court have to declare the lower Federal Judge's opinion to not be right and thus hear the case themselves? How does all this work?
