Protect Our Elections, Public Citizen, And Center For Media And Democracy File Complaint Against American Future Fund For Using Secret Money To Fund Election Ads

Group Operates As a Political Committee But Is Not Registered As One


Our ProtectOurElections, www.protectourelections.org, campaign yesterday filed a formal complaint with the Federal Election Commission against American Future Fund (AFF), an organization created by Republican operatives to influence the midterm elections with huge expenditures of money. Public Citizen and the Center for Media and Democracy joined in the complaint.

AFF, a conservative nonprofit group pouring money into the 2010 midterm elections, is violating campaign finance law by failing to (1) register as a political committee (2) do proper recordkeeping, and (3) report and disclose income and expenditures. AFF is registered as a 501(c)(4) organization and is therefore prohibited from urging citizens to vote for or against a specific candidate. However, AFF has released dozens of ads asking voters to “vote against” named Democrats.

“In this first post-Citizens United election, corporations and their executives are testing the limits of the law and crossing over into illegality,” said Kevin Zeese, spokesperson for ProtectOurElections.org. “They cross the line when they use nonprofit groups to urge people to vote ‘for’ or ‘against’ a specific candidate. Political committees violate the law when they accept anonymous contributions for their work. These violations of federal election and tax laws need to be challenged now; otherwise we will see even more anonymous corporate donations trying to illegally manipulate voters into voting against their own interests in future elections.”
