WASHINGTON — An Army doctor has been charged with disobeying orders after failing to show up for duty in Afghanistan and questioning whether President Barack Obama has the right to order him there.

Lt. Col. Terrence Lakin is scheduled to be arraigned Friday at Fort Belvoir, Va.

The Greeley, Colo., native did not report to Fort Campbell, Ky., in April to prepare for deployment.

Lakin said in a YouTube video that he chose to disobey orders and was inviting his own court-martial. He says he wants to see Obama's birth certificate as proof Obama was born in the U.S., as presidents must be, and thus that the deployment order for Afghanistan is legal.

Hawaiian officials say they have records proving Obama was born there, but so-called birthers challenge that.

According to CNN Lakin entered a deferred plea. He may be trying to cook a deal and avoid prison time?

7. A court martial is not like a civilian trial. He WILL face jail time in
the Disciplinary Barracks at Leavenworth, KS. He deliberately missed a troop movement, which is a very serious charge-he did not go with his unit to a combat area, and later refuesd orders from his commanding officer and later from a higher commander to report for travel with his unit.

He does not contest this - he states that the orders were illegal because Obama is not a US citizem and therefore not really President.

His problem is simple - the Army does not really care what his motive was. He missed the troop movement on purpose, then refused to obey several orders to go with his unit.
I have no doubt he will be convicted on all of these charges, and he could face several years in prison, loss of all his rank, pension and benefits from his 18 year Army career.

By the time he is out of Leavenworth, Obama will be retired from his second term.

8. The charge is much more serious for an officer than for enlisted, too.
Especially a fairly senior officer like a Lieutenant Colonel, because officers set the example and are the leaders. If a senior officer is pulling shit like this, the effect on discipline and morale is much greater than if a junior soldier did it.

10. ...and the court martial judges will certainly take this into account
when issuing a verdict and a sentence. There is no "jury", but a panel of officers who are the judges who pass sentence - it is very different from a civilien court, and there is a lot less bullshit allowed.
He will not have a good outcome from this.
