EmptyWheel: THE MAR-A-LAGO INDICTMENT IS A TACTICAL NUKE

The big indictment of Trump and Nauta is likely tactical. DOJ most likely is trying to get Nauta to flip. Nauta could be charged with lots. There is another investigation focused on Bedminster and Trump related to classified documents.

The investigation didn’t move, entirely, to Florida. Part of it was presented to a grand jury in Florida. But there are other parts that remain in DC, and those parts that remain in DC had to be told this indictment was coming.

This indictment is, in very significant part, a renewed invitation to Walt Nauta to cooperate in an ongoing grand jury investigation into what happens to documents when they go to Bedminster and disappear forever.

The indictment: In the hours and days before Trump's lawyer visited Mar-a-Lago to search for documents in a storage room, Trump directed his aide and now co-defendant, Walt Nauta, to move 64 of the boxes out of the storage room.

The indictment: After the grand jury subpoena, Trump said to his attorneys, "Wouldn't it be better if we just told them we don’t have anything here?"

Per the indictment, Trump in June flew boxes AWAY from MAL after meeting the FBI and telling them he was an "open book"--

"Earlier that day, NAUTA and others loaded several of TRUMP’s boxes along with other items on aircraft that flew TRUMP and his family north for the summer."

Special counsel Jack Smith made a statement on the indictment unsealed today against former President Donald Trump.

Said Smith: “This indictment was voted by a grand jury of citizens in the Southern District of Florida and I invite everyone to read it in full to understand the scope and the gravity of the crimes charged.”

He added: “We have one set of laws in this country and they apply to everyone… My office will seek a speedy trial on this matter, consistent with the public interest and the rights of the accused.”
