RE: Shitler asking Rosenstein for loyalty - Renato Mariotti's take on how this affects investigation
1/ This is huge news--it's the same pattern of behavior that Trump engaged in with @Comey. At this point, there can be little question that Rosenstein will be a witness for Mueller. It's hard to see how he can continue to oversee the Mueller investigation.
2/ That said, for months, it has appeared that Rosenstein would be a witness for Mueller given that his memo played a role in Comey's firing. At this point, however, it looks like Trump's behavior towards Rosenstein mirrors some of the behavior alleged by Comey.
3/ That makes Rosenstein a potentially critical witness, for two reasons. First, it shows that Trump engaged in the same behavior even after he knew he was under investigation for obstruction of justice and viewed analysis showing that his actions towards Comey were problematic.
4/ That is strong evidence of his intent. Also, the behavior towards Rosenstein tends to corroborate Comey--in other words, it suggests Comey was telling the truth about the "loyalty" conversation. Rosenstein's account would undercut an attack that Comey misinterpreted Trump.
5/ If Rosenstein recuses himself, Associate Attorney General Rachel Brand would oversee the investigation. It's unclear how Rosenstein could justify not recusing himself at this point, but given that he has stayed in the case thus far, it's possible he does not recuse. /end
