BY JOSH DELK - 03/08/18 07:33 PM EST
Former adult film actress Stormy Daniels has recorded an interview for CBS's "60 Minutes" after filing a civil suit against President Trump this week in an attempt to void a nondisclosure agreement between the pair.
A source familiar with the program told The Hill that Daniels, whose real name is Stephanie Clifford, will appear on 60 Minutes on a future date but won't be on the program this coming Sunday.
Michael Avenatti, the attorney representing Clifford, tweeted a photo of himself Thursday along with the actress and CNN anchor Anderson Cooper, a contributor to "60 Minutes."

Avenatti asserted during an interview earlier this week that Clifford had a past sexual relationship with Trump. The lawyer also called the White House's claim that the president had no knowledge of the reported payment by longtime Trump attorney Michael Cohen to keep Clifford quiet "patently absurd."

(46,104 posts)First, he'll be on the record validating that he was one of the parties of the NDC. Not good.
Second, the $1 million per violation is unenforceable IMO. Contract Law does not consider a contract to be valid and enforceable if the terms are "unconscionable", meaning that enforcement of the term would be outrageous and shocking to the average person.
Third, all Trump's got is potentially defamation is she says something like he confided to her that he really isn't a billionaire, and even that puts him at risk of losing the message and his legal action being dismissed or losing a motion for summary judgment.

(52,227 posts)Well, I do agree with your first point. Donnie may well steer clear of the whole thing, preferring to deny the whole thing. Or sue once hes out of office, anyway.
Regarding the unconscionable thought, she basically sold her story to Donnie. Theres nothing unconscionable about that. Legally, thats a tough sell.
As for damages, thats a wild card with someone like Donnie. Ordinarily, it would be easy for a celebrity and/or businessman to claim huge damages should something scandalous like this be revealed. Damage to brand and therefore profits. Easy argument.
The wrinkle in Donnies case is that hes already got the reputation of a slime and womanizer and worse, so its harder for him to tie damages to stormys specific claims.
