Even this SCOTUS would uphold a Mueller subpoena.

I count six votes-Breyer, Kagan, Sotomayor, Ginsburg, Kennedy, and Roberts.

Surprisingly I believe Gorsuch is a wild card, not Alilito or Thomas.


It might even be 9-0 like the Nixon tapes. There is nothing a jurist can point to in the Constitution that says a president can ignore a subpoena.

This should be 9-0. Trump could argue executive privilege to protect certain documents and discussions. There are no provisions to not talk at all.

I have a lasting concern from Bush v. Gore that SCOTUS cannot help itself from making political decisions.

That Court ruled recounting some counties and not others violated the 14th Amendment due process clause. At least they found a basis for it in the Constitution.

The correct ruling was to recount all the counties.
