Parkland victims sue, calling gun maker and seller complicit in massacre

FORT LAUDERDALE, Fla. - The families of two victims of the Marjory Stoneman Douglas shooting on Wednesday sued the maker and seller of the weapon used in the rampage, claiming they should be held partially responsible for what Nikolas Cruz did with it.

The parents of Jaime Guttenberg and Alex Schachter want a judge to clear the way for them to claim damages against American Outdoor Brands, formerly known as Smith & Wesson, and Sunrise Tactical Supply. The Coral Springs store is where Cruz purchased the AR-15-style weapon used in the Feb. 14 shooting spree.

Fred and Jennifer Guttenberg, and Max Schachter "seek to hold defendants legally responsible for their complicity in the entirely foreseeable, deadly use of the assault-style weapons that they place on the market," according to the lawsuit, filed in Broward Circuit Court.

Before the lawsuit can go forward, their attorneys said, judges have to clarify that gun manufacturers and sellers can be sued by victims.

"A confusingly written Florida statute stands in the way," the attorneys wrote. "If the defendants claim that (the law) entitles them to immunity from such claims, and the courts agree," the victims will be forced to pay the gun maker's and seller's legal fees instead of recovering damages.

if the parents are forced to pay any damages. I just hope the judge allows them to sue. That would set a great example. I wish someone would sue the parents or guardians of shooters who keep weapons in unlocked areas, especially when their child is having behavioral issues like at Parkland and Sandy Hook and Texas. They should be held responsible too. If they are then perhaps future situations will be slightly less likely to occur. We must try stop this any way we can. I am sure there is some legal reason why they can't but I am not a legal expert.

" Cinemark, the company that owns the Aurora cineplex where 12 people were murdered in 2012, is seeking nearly $700,000 from several victims of the attack who unsuccessfully sued the theater chain.

Lawyers for Cinemark earlier this month filed a “bill of costs” for $699,187.13 in Arapahoe County District Court. Colorado court rules say that the winning side in a civil case is allowed to recover its litigation costs."

The gun maker and seller have *NO* reason to be sued.
Should I sue GM for the Buick that hit me head-on years ago?
Should the families of terrorist victims sue the makers of trucks?

Knife makers?
Hammer makers?

I have no doubt an ambulance-chasing lawyer got in contact with these people and convinced them the gun maker should be sued.

11. I agree with you. Everyone knows what guns are made for. Sadly, they are being legally sold.

This is on the government, not the manufacturer. We need legislation to outlaw some guns completely and restrict others. We also need to make sure anyone allowed to own one isn't a maniac and knows how to safely handle and protect a firearm.
