Mon Aug 13, 2018, 06:38 AM
Aug 2018

Taking one in and using it is bigger.

She just, among other things, opened the door for a search warrant to be issued that would allow saatchnof virtually everything she owns including all her online history, email, digital files etc.

You don’t take recording devices in a SCIF. And you don’t double down on that by using one in a SCIF. And if you do then for the love of god you don’t go brag about it.

It won’t matter if what she released was classified or not. The possession and use of a recording device in a SCIF is itself a crime, as is the use.

And now that she’s admitted to doing that it will be the easiest thing for the government to say to a judge “This person has admitted to possessing and using a digital recording device in a SCIF. We need a search warrant to ensure there isn’t any classified material she may have in her possession or may have passed to other parties.”

Then once they have access to search every minute detail of her life, just wait for the embarrassing leaks and/or the prosecution on totally unrelated things they happen to discover.

You can not deflect at all her responsibility for that decision on to him.

She would have been very much aware of what is and is not permissible. It would have been briefed to her as part of the procedure for granting clearance to work in the White House and as part of getting her security clearance at whatever level she did.

You can’t take a recording device in a SCIF unless it’s one that is cleared to handle whatever level of information the SCIF is cleared for and is marked accordingly. Not even one turned off with batteries out. That’s something taken very seriously. You can’t record on top of that.

Any way you cut it, she broke the law and just bragged about it to the world.

People with access to classified materials are expected to follow rules.

You don’t get strip searched every time you enter a SCIF.

The times the system fails the most is when people who were entrusted fail to meet their obligations and live up to the standards they agreed to.

Navy Submariner takes his cell phone into the Submarine and takes a few selfies at his work station. The equipment in his work space was classified and taking photos there was just as illegal as recording in the situation room is.

The photos were found later on his phone during an unrelated investigation. No indication he ever improperly shared them.

He was prosecuted and convicted.

And Trump recently pardoned him- so that’s gonna make it hard for home to claim he is doing any prosecution of her that isn’t from a position of retribution.

41. My questions
Mon Aug 13, 2018, 09:30 AM
Aug 2018

and observations

KELLY is the one who should be worried. He is the one that chose that room to fire her in. WHY? He has an office, it would have been easier there. Did he bring her in there specifically because it was a secured place? I am guessing she, nor the lawyers in the room had security clearence to be there. Kelly LEFT the room, which is a breach of security. Jared just got his security clearance via trump because he couldn't pass a background check. There is no reason to believe Omerosa had one when she was fired in Dec 2017.

Because she had no idea why Kelly was meeting her, or that he was taking her there, without a security clearance she may not have even known the security protocols for the room. But kelly did and he broke them. I believe he brought her to there specifically because he didn't want a record of what he + the lawyers were going to say and do.

With his racist attitude and derision towards Omerosa, why would he even care if she made a scene when she was fired? It would publically humiliate her and feed into his ego.

50. Yeah, it's not going to work like that
Mon Aug 13, 2018, 10:28 AM
Aug 2018

Anyone working in a place like the White House will have received extensive briefings on security procedures and what is acceptable and what is not. And there will be records where they sign acknowledging that training.

There is no way she didn’t know that recording was prohibited in that space.

Even if Kelly also failed to properly adhere to the security procedures and regulations- and it’s a pretty big leap to assume that- it doesn’t change the elements of what she did one bit.

I would expect that as part of the basic procedures for working there she at a minimum had a Secret clearance, even if it was an interim one while waiting for final adjudication. Even the janitorial staff there has a clearance of some sort. I doubt based on the nature of her “work” she would have ever been sponsored for a higher level clearance, and a Secret is fairly routine to get.

But she absolutely would have known better.

Mon Aug 13, 2018, 10:35 AM

If this were in a home or private office it would be legal because DC is a single party consent law jurisdiction. Under the laws of single pet consent jurisdictions only one party of a conversation must be aware of recording.

In a “two party” state everyone being recorded must be aware.

That how people like O’Keefe get away with the video they make.

But because it took place in a secure facility any recording is illegal.
