Making a plea deal to falsely admit to a crime is a big crime too.

So options are

1) Defend against a false charge, whatever it takes.

2) Defend against a true charge of a crime committed.

3) Take a plea deal for a crime not committed, which commits a new crime.

4) Take a plea deal for an actual crime.

In three of the four, there is a crime. The only one without a crime is the first option, where there is no plea deal.
