Scott Dworkin explains why he and the Democratic Coalition filed a criminal complaint to the US Department of Justice against Judge Brett Kavanaugh with the legal counsel of Massachusetts lawyer J. Whitfield Larrabee. Scott and Jon Cooper, who is the Chairman of the Democratic Coalition, both joined the complaint individually. A parallel judicial ethics complaint will be filed with the Clerk of the DC Circuit Court for Chief Judge Merrick Garland to review on Monday morning. Transcript

(13,594 posts)There is no such thing as an individual or group "filing a criminal complaint."
"A criminal complaint must state the facts that constitute the offense and must be supported by Probable Cause. It may be initiated by the victim, a police officer, the district attorney, or another interested party. After the complaint is filed, it is presented to a magistrate, who reviews it to determine whether sufficient cause exists to issue an arrest warrant. If the magistrate determines that the complaint does not state sufficient probable cause, the complaint is rejected and a warrant is not issued. In federal court, the complaint is presented under oath (Fed. R. Crim. P. 3)."

It will get a quick review and then dismissed.
This group has a history of doing this and nothing comes of it so don't get your hopes up.
Also, as has been pointed out several times here on DU, they have no standing to bring a criminal complaint.

(13,594 posts)What you're describing is the same thing as someone calling the police on their neighbor for making too much noise (or killing someone, for that matter.) The fact is that only the state (municipal, state or federal district attorney) has the power to file a criminal complaint.

(279 posts)This is a complaint filed with the DOJ asking them to investigate Kavanaugh and then for the DOJ prosecutors to file an indictment against Kavanaugh. It's a real procedure. The second item is an ethics complaint filed with the DC Circuit asking the chief judge (Merrick Garland) to investigate. This is also real procedure. I agree, however, that it is highly unlikely that either of these will go anywhere.

(4,066 posts)I am glad there are so many people going on record about the dishonesty of Kavanaugh.
Unfortunately, dishonesty in service to a Republican President is not a dis-qualifier for the Republicans in the Senate. In fact, for them, it is a reason to approve him.
