An attorney for the family of a man shot at his home by an off-duty Dallas police officer said he believes authorities are trying to damage the victim's reputation by searching his home for drugs and other illegal items.
Investigators said in a search warrant of the apartment of Botham Jean, 26, that they were looking for "any contraband, such as narcotics, and other items that may have been used in criminal offenses." Investigators later said in a court document that they found 10.4 grams of marijuana during Saturday's search.
Civil rights attorney Lee Merritt said Thursday the search shows that police want to besmirch Jean, who worked in risk assurance at PricewaterhouseCoopers and was a graduate of a private Christian university.
"The warrant seems to only be designed for one particular purpose," Merritt said, "and that is to smear the victim.

(5,969 posts)As someone who is not in law enforcement and who isn't a lawyer, I fail to see the point. Whatever they might find, it has nothing to do with what happened. Her most generous story (that I don't buy) is that she saw someone in the dark who didn't follow her orders. This wasn't an official police operation entering his house with a warrant to search for drugs. She didn't claim that he had a weapon, as far as I know. I'd bet that normally, when you are unarmed and getting shot in your own home, the investigation doesn't spend much thought about trying to find out whether you were a danger to the intruder.
A person, who just happened to be a cop, got access into someone's home and shot an unarmed man dead for no reason. If the shooter hadn't been a cop, would we see these efforts to search through the victims house? The only concern they should have regarding his home is trying to find out what happened and not go through personal stuff unrelated to the incident. This seems like such a final and unnecessary intrusion of a dead person's privacy that one has to ask whether the whole investigation isn't corrupted from the beginning. Talk about adding insult to injury.

(5,969 posts)Banging on the door and demanding to be let in would contradict everything she said. It would be getting closer to murder in a rage. But it remains to be seen whether the investigation will be impartial.

And even if they did, they gave her plenty of time to hide anything incriminating.
I think Dallas is going to be pretty fucked when they finish with this travesty of "justice".
