Cohen "discovered substantial files on a hard drive" - ready to trade for more time on the outside

Washington (CNN)President Donald Trump's former lawyer and fixer Michael Cohen is offering Democrats new information in a bid to stay out of jail while he cooperates with Congress.

Cohen's attorneys Lanny Davis and Michael Monico told lawmakers in a letter Thursday that Cohen has discovered substantial files on a hard drive that might be helpful to investigators.

Cohen is asking for additional time -- and congressional help -- to persuade the Southern District of New York to allow him to postpone reporting to jail in order to review the files. Cohen's lawyers wrote in the letter, obtained by CNN, they hoped Cohen would receive a reduced term, and that the May 6 date Cohen is scheduled to report to prison "will be substantially postponed while he is fully cooperating with prosecutors and Congress."

He is asking top Democrats on the committees where he testified to write letters outlining his cooperation that he could use to lobby prosecutors for a lesser sentence.

Was not this hard drive the subject of a subpoena? If that is the case did Cohen withhold evidence under subpoena? If so, this should not be subject to negotiation although continuing to cooperate with prosecutors could weigh on his final sentence. But I sense a whiff of blackmail being played here.

That is part of the reason they were not as accommodating as Mueller was when it came to recommending a sentence.

Now, it appears he's playing his final card to see if he can shave time off his sentence.

One danger is if there is any evidence on that drive that shows Cohen lied to them ... I'm sure Lanny Davis would work out an arrangement with that contingency or they're being really stupid.

With that much new evidence, if the report is accurate, they could nail a few people.

That prosecutors had the hard drive and returned it only a couple of days ago. That means that there is nothing new here for prosecutors. While it would be new to Congress, it seems that this hard drive has already been factored into the sentencing duration for Cohen. But this revelation does put Cohen in a more favorable light.

29. Just because there were some subpoena's and such on MC doesn't mean they

required every single thing Cohen had from any interaction with anyone tangentially related to Trump ... be turned over. Generally there are specific cases, targets and timeframes and such laid out. You can't just say 'give us everything you've ever owned' in a warrant.

Seriously doubt that this is something that SDNY had a warrant to 'get', but Cohen 'held out' ... and now him and Davis think they're to negotiate with it.

Could be a drive from 8 years ago for all we know. He could also have proof in the form of testimony from an old IT firm he used to employ, saying 'we just found this', that kind of thing.

30. I Realize Most Of What They Had On Cohen

Came from the search warrant the FBI executed and a special Judge ruled on what was protected by Attorney Client privilege and off-limits so I'm not even sure there was a subpoena involved. And if the FBI missed it when they performed their search he could be off the hook. But there is also the terms of his cooperation agreement and that should have called for full disclosure, including this hard drive.
