House just authorized Chairman Nadler to go to court to enforce subpoenas and obtain grand jury info

H.Res 430 passed on a straight party line vote, 229-191.

That the chair of the Committee on the Judiciary of the House of Representatives is authorized, on behalf of such Committee, to initiate or intervene in any judicial proceeding before a Federal court—

(1) to seek declaratory judgments and any and all ancillary relief, including injunctive relief, affirming the duty of—

(A) William P. Barr, Attorney General, to comply with the subpoena that is the subject of the resolution accompanying House Report 116-105; and

(B) Donald F. McGahn, II, former White House Counsel, to comply with the subpoena issued to him on April 22, 2019; and

(2) to petition for disclosure of information regarding any matters identified in or relating to the subpoenas referred to in paragraph (1) or any accompanying report, pursuant to Federal Rule of Criminal Procedure 6(e), including Rule 6(e)(3)(E) (providing that the court may authorize disclosure of a grand-jury matter “preliminarily to... a judicial proceeding”).

I'm waiting patiently but I also want to see results.

Have they received the full Mueller report, and grand jury materials? No.
Have they received Trump's tax returns? No.
Has Mueller, McGahn, etc. testified? No.

I see the reference to grand jury materials but haven't heard much about executive privilege.

Much of the evidence and testimony, while instructive and helpful, may not be as valuable as some think because, I expect, a lot of it won't be able to be released to the public, even if disclosed to the House Members.

One of the most valuable things they can get from the grand jury testimony is WHO testified and WHAT they testified about. With that information, the committee can call those witnesses to testify in their own hearings and ask them the same or similar questions that they were asked in the grand jury - but do it in public - with the witness knowing that they're already on record under oath and, if they change their testimony, they'll be looking at perjury charges.

In other words, even if they don't get ALL of the grand jury material or can't disclose it all to the public, the materials will give them enough information to virtually replicate the grand jury proceedings. The material provide an excellent roadmap.

Even though a "trial" is held by the Senate it is under congressional constitutional powers and not those given the judiciary. The Congress would have to make a referral to DOJ, who would then decide whether to charge and the files could be opened to DOJ/FBI for their investigation/judicial proceeding.

I'm not sure if the court will decide that the cited exception applies. Haven't researched it, hopefully someone else has.

Eric Holder, Obama AG was found in contempt of Congress under exactly the same circumstances. That was delayed until the Trump DOJ finally settled the case.

Congress can't just do whatever it wants whenever and however it wants. There's a process that must be followed and that's what they're doing. Today's action makes that process move much fast

Why vote on it at all?

If they are going to ask for subpoenas to to be adhered to, why not ask that they do it expeditiously, with a definite time?
