Federal law as enforced by the U.S. Equal Employment Opportunity Commission counts discrimination based on nation of origin as one of several kinds of prohibited discrimination.
One example the EEOC lists on its website matches nearly word-for-word the Presidents tweets.
Examples of potentially unlawful conduct include insults, taunting, or ethnic epithets, such as making fun of a persons foreign accent or comments like, Go back to where you came from.
Highlighting the EEOCs language Tuesday, Sen. Tim Kaine (D-VA) wrote, The Presidents bigoted words are so contrary to who we are as a country that we literally have laws against them.

(37,163 posts)...is complete electoral disaster. Right now they know they'll pay a price for defying Trump and the foaming Republican base, so they knuckle under. Occasionally some will feel the need to rise from prostrate position to on their knees to mumble a mild complaint, but it never lasts more than a day and they get back all the way down as soon as possible.
They won't act until they know they'll pay a price with the rest of the electorate if they keep doing that.

Ethnic slurs and other verbal or physical conduct because of nationality are illegal if they are severe or pervasive and create an intimidating, hostile or offensive working environment, interfere with work performance, or negatively affect job opportunities. Examples of potentially unlawful conduct include insults, taunting, or ethnic epithets, such as making fun of a person's foreign accent or comments like, "Go back to where you came from, " whether made by supervisors or by co-workers.
