Just wondering....
While a pResident is under Impeachment, can he fill a vacant Supreme Court Justice seat?

There are no restrictions on what a president who has been impeached but not yet tried or convicted can do.

(18,654 posts)Because the powers of the President are listed in the Constitution. They can therefore only be restricted by an Amendment to the Constitution.

(146,308 posts)Impeachment does not take away any powers from a sitting President. Unless he is convicted in the Senate and removed from office, he remains the POTUS and can do anything a POTUS can do.
It's a very simple answer to all such questions.
