as ghoulish as it is, it probably should be released. If it is clear cut self defense as the DA claims, the video should back it up.

telling the protesters to move along isn't he committing aggravated assault? Shooting someone who is attempting to disarm him is not self defense in that case. He has no legal authority to brandish a weapon.

I'm not a fan of killing to protect property. Obviously it is different if I have loved ones in the place or if my life is threatened, but there is no stuff in my home worth killing for, and no stuff in my business worth killing for. That's MY personal stance. I can, however, understand someone else fighting to protect their stuff, especially during a riot where gangs of looters are doing exactly that . . . looting.

Maybe there are some maybes that will come out. Maybe the shooter intentionally escalated the situation by stepping out and calling them names and suggesting they were pu**ies who wouldn't dare step into his place. Maybe the guy was putting him in a choke hold because the shooter had just threatened to kill them all just for the fun of it. Maybe the police are lying about what is on the video. We could maybe all day, but that does little to help the underlying cause.

Yes, let's scrutinize the hell out of the facts - as we should whenever a life is taken - but we are all capable of doing the right thing, even when, or maybe even especially when, one of the actors is the kind of person that makes our skin crawl.

From the article at the link. A law enforcement official with knowledge of the video gave this account:

"Saturday night, standing outside his downtown bar, Gardner urged the crowd to move along.

Gardner could be seen talking with a group of young men, including Scurlock, and backing up. In one video circulating online, a cellphone user says, "That (expletive) got a gun."

Words were exchanged, and Gardner ended up on his back in the middle of Harney Street. He fired two warning shots, the source said. The skirmish continued, and Gardner remained on his back, with Scurlock getting Gardner in a chokehold. Gardner fired again. That shot hit Scurlock in the neck, killing him."

This is a tragedy on all counts, but even this right wing nut job can't be expected to lay idle as someone gets him into a choke-hold. Perhaps there is more to the story - there almost always is - but it helps no one to ignore the details.

He stood outside, in a crowd, illegally brandish a gun and ordering people to move along. He had zero authority or moral right to do that. He seeded and reaped that man's death.

Tensions increased Monday morning as authorities gave businesses a heads up that Gardner was going to be released. By late morning, officials were urging businesses to board up their windows in case of an outbreak of vandalism. Douglas County Courthouse employees were told to go home, and sheriff’s deputies who work security at the courthouse were monitoring the grounds.
