It sounds like Sullivan can win the question re: whether he can hold a hearing... but it also sounds like he won't be able to rule against the government in dropping the case.

Sullivan's attorney just said as much in questioning. She's arguing that mandamus was inappropriate, but expects that IF Sullivan gets the hearing and rules against the government... she expects this court to overrule him.
