Us versus him

... He does not wear a mask, though the world is fighting a deadly disease that spreads through respiratory droplets. He walks with his attorney general, his chief of staff, his secretary of defense, his press team, his daughter, and his son-in-law. They are not wearing masks either ... He stops in front of the church’s sign, whose black and white lettering reads “Sunday Services Online.” The services are online because covid-19, the disease caused by the new coronavirus, has by this point killed more than a hundred thousand Americans ... It is the first day in June, and the sun shines in Washington ... His eyes are narrow — the look of a man who wants to look determined; the look of a man with sun in his eyes, so perhaps he cannot see.

Moments before he arrived at this spot, officers cleared the square of a crowd that had been protesting peacefully as part of an uprising against systemic racism, in particular police brutality targeting Black people ... But that day, the Congressional Budget Office projected that, over the next decade, without serious help from Washington to confront the losses caused by the pandemic, the US economy could become $15.7 trillion smaller ... The federal park police descended, in riot gear, firing off rubber pellets and spraying the area with tear gas. Puffs of smoke filled the air; legs went spiraling in all directions, arms waving. Fear, shouts, coughing ... The cameras rolled.

This is a snapshot of a presidential campaign season that has been unlike any other. The coronavirus has disrupted the usual election cycle routines — the bus rides, the stump speeches, the canvassing, and all the accompanying coverage ... He has since waged a campaign that is not so much against his political opponent as it is against the American people ... But in truth, the uprising tells the campaign story.

While officers in Washington met demonstrators with tear gas — a chemical agent so harmful that it was banned from warfare by signatories of the Geneva Conventions — the same was going on in Portland, Oregon ... Officers also beat up protesters and shot projectiles their way ... “We can be forgiven for believing the president is more interested in power than in principle, more interested in serving the passions of his base than the needs of the people in his care” ...

... at the beginning of June, the Portland police were stocking up on military gear. KATU, an ABC affiliate in Portland, obtained records showing that the city’s police bureau spent nearly $50,000 on tear gas, pepper spray, and related items ... Then officers started spraying demonstrators with chemicals every night. By June 5 .. protesters filed a class action lawsuit against the city of Portland for “indiscriminate use” of tear gas. “We’re out screaming for justice for Black people and asking the state to stop its violence against us, and the City responds by using tear gas when we’re in the middle of a pandemic of respiratory disease” ...

1. Federal agents are coming to Milwaukee

The surge of federal agents into Milwaukee is part of the federal Operation Legend, which supposedly addresses violent crime in several major U.S. cities: Kansas City, Chicago, Albuquerque. It is now being expanded to Cleveland, Detroit and Milwaukee. The agents coming to Cream City are meant to cooperate with state and local law enforcement in order to reduce violent crime, in particular gun violence. “In Milwaukee, homicides are up 85% this year, and non-fatal shootings are up 64%,” the Department of Justice explains.

Unlike Kansas City, which saw an influx of some 200 federal agents, Milwaukee will only receive 10 federal investigators in the immediate future. At least 15 more will be assigned to the city over the coming year. Additionally, the Bureau of Justice Assistance will grant $12.1 million dollars to the project and to hire 29 new police officers in Milwaukee County. The operation will be under the leadership of Matthew Krueger, U.S. Attorney for the Eastern District of Wisconsin.

Gov. Tony Evers came out against Operation Legend in a letter addressed to President Donald Trump. “I am writing to convey my strong opposition to any such intervention,” the governor wrote. “This is not a moment to double down and unnecessarily increase police presence, especially without invitation ... This type of unilateral intervention has not been requested by either the City of Milwaukee or the State and is not welcome in Wisconsin.”

The governor was not alone. Sen. Tammy Baldwin, Milwaukee Mayor Tom Barrett, Rep. Gwen Moore and Milwaukee County Executive David Crowley united forces with Gov. Evers to demand answers: “Neither the President nor Attorney General Barr consulted us, as elected leaders for Wisconsin and Milwaukee, about this increased federal presence,” they state. “We want to make it very clear that we do not support anything similar to what we have seen in Portland, Oregon, here in Wisconsin” ...

2. Detroit never needed Federal troops

The proposed dispatching of federal troops to Detroit to curb protests was both insulting and unnecessary, but did prompt a lot of discussion around what we need to address the issue of violence in our community.

Sending in federal troops would have done more harm than good and jeopardized the slow but peaceful efforts already underway to tackle the issues we know and understand better than any outsiders.

While no justifiable reason was given for the proposed federal presence, here or in other cities, it was a painful reminder that Detroit knows all too well of the damaging impact of federal officers. Washington’s response to Detroit’s 1967 rebellion left a singed imprint on this city, its residents and our reputation ...

As an organization dedicated to civil liberties, civil rights, and the rule of law, we at the American Civil Liberties Union believe that the government has both the authority and responsibility to enforce its laws — laws that promote justice, equality, and the general welfare. In recent weeks, the actions of federal agents have shown us all that the Department of Homeland Security isn’t capable of acting consistently with the Constitution, and should no longer exist in its current state.

The scenes unfolding in Portland, Oregon, and elsewhere are a reminder of the red flags many have raised about DHS throughout its history: that its powers are too great, and that it lacks the oversight and management to be effective. We can preserve our freedoms and our security better by dismantling DHS and beginning anew.

People across the political spectrum watched in disbelief as federal agents were deployed to American cities — despite objections by mayors and governors — to escalate violence against protesters. Paramilitary forces abducted people exercising their constitutional rights in Portland, placed them in unmarked vehicles, and took them to undisclosed locations.

The tactics deployed by DHS agents are unlawful and shocking, but they are no surprise: Back in 2002, we at the ACLU called the initial blueprints for the behemoth bureaucracy “constitutionally bankrupt” ...
