And I mean EVERYTHING. There will be no law that Biden signs that some nut wing will take to a court and say it validates their constitutional freedoms. I think even a minimum wage will be struck down. Everything will be freedom of religion, civil liberties, etc. The ONLY remedy we have it to expand the court.
Of course, this is assuming Trump's replacement gets a vote. The only way the Court doesn't expand is if Biden gets to choose her replacement, otherwise, we're in big shit even if Biden wins.

(81,486 posts)The Supreme Court is not some sacred temple of law and equity. It has become a political institution (Exhibit A: Bush v. Gore)
It is time for people to wake up and realize that Republicans are using the judicial branch as a means to maintain veto power over Democrats and to perpetuate minority rule.

(34,857 posts)Even if Biden came out tomorrow and said, if elected, he was going to add two additional justices, doing so will require holding the entire majority in place - if the Democrats get a majority.
Because I guarantee you no Republican is going to come out and support it.

I doubt it. Joe Manchin is not going to support it. That right there, with the razor thin majority the Democrats have, likely ends any court packing scheme.
And even if it were to pass - it sets up the GOP to turn around and add additional justices when they win back the WH and Senate. Where does it end?
It becomes a political football and delegitimizes the courts.
The most likely solution is not the best but it's to introduce term limits. 18 years.
But I don't see adding two additional justices to the court proving at all viable.

(509 posts)That's an idea that would be considered more fair. They could randomly select 4 judges from the appellate courts to work on cases and it would be random so no one would know ahead of time. That would solve a lot of your concerns about Republicans gaining power and doing the same thing.

(26,044 posts)Remember, it's similar to what we see now: if we get a 53-47 majority in November, for example, we can afford to lose Manchin and two others, with Harris breaking the 50-50 tie.
Nevertheless, I think we need to leave the option open, and very explicitly so, at least as a threat that might persuade a few crucial Republican senators to hold off on confirming a replacement until a new presidential term begins.
(And, by the way, I have thought term limits are a good idea as well, but not on that schedule. More like "the longest sitting Justice has to retire every second year." That way, a president can nominate a maximum of two new Justices per term. Otherwise, some presidents might get the chance to name three or more, while others might not get a chance at any.)

But, things eventually changed without the packing. And no matter what happens this November, things will change again.
everybody stop the hand wringing and get out the vote.
