continues to be a pressing and necessary issue. Without the ERA in the Constitution, any and all rights to women can be judicially nullified.
With ACB's nomination pending, almost any issue concerning gender discrimination (e.g., women being paid less than men, men being hired instead of women, etc.) can go to a conservative USSC and rights will be stripped from women.
That is not to say that I honestly wouldn't be surprised to see any particular ruling that is in direct contradiction of the Constitution and caselaw come down. We're looking at judicial activism with a mission and on steroids.

I don't trust reliance on the Twelfth through Fourteenth Amendments as they can be subject to "misinterpretation." True equal rights.
We have to plan on strengthening democracy, not merely defending it.

(25,499 posts)Unfortunately, there is zero chance of that happening in the current political environment. They can certainly bring attention to it, but there are roughly 15-20 states that are pretty reliably red that won't buy in.

some rescinded their passage.
I think the case is now in the court system to determine whether the deadline is controlling and whether rescissions are recognized.

(25,499 posts)We'd have to start over. Five states have rescinded their passage. Four of the five did so prior to the deadline in 1979 and are unlikely to be forced to revert.

(652 posts)when I was in high school, I went to the GA legislature's discussion of the ERA, to report on for my school. This had to be around 1973. I was so disgusted, listening to the arguments against it by the legislators. We stayed for one day of that tripe. The next day we went to Stone Mountain to fly kites and get those nasty misogynists' words out of our heads. Yeah, we skipped school. We also climbed the east side of Stone Mountain that day. Found out later that was dangerous -- we climbed over the fencing. Maybe there is something to 16 and 17 year olds not having common sense! Got caught. Got suspended. Didn't care.
I cannot believe that so little progress has been made in nearly a half century.

it always killed me that 'they' said-oh, if you pass it, women will be able to get abortions. well, duh. you just made the case for why we need it. and outed yourself on why you oppose it.

(34,135 posts)As of now I feel OK about my state because our Supreme Court is liberal. It is law that even if Roe V Wade is abolished by the Feds, Kansas will still allow it. There are restrictions that I do not agree with but you can do it if you need it lawfully and without hiding it.
This does not mean I do not think we have to fight more. I thought we had enough states to make it federal law when Virginia came in. Was there something about it being too late and it needs to be voted on again? My poor old brain can only hold so much and this administration has filled it with so much crap so fast that nothing stays for long.
This MUST be done. I still find it hard that I have lived my entire life without protection from my Government. Not one woman here can say differently.

(10,106 posts)And that vote should be determined by the man. Her name is Abby Johnson, and she is an anti-abortion activist who spoke at the RNC and made all the false claims about late-term abortions, including that women were delivering healthy babies and then killing them.
These people do not believe that women should have any rights at all. Yet, they have all the rights they want to deny other women. Abby Johnson has had a career. She is a national activist. She is married and has 8 children, one of whom is adopted. She wants to deny women the right to vote and to make choices about their own livesthe same sorts of choices she has had the right to make.
Im curious about the number of children that women like Amy Coney Barrett and Abby Johnson have. The number is outside the average today, which is less than two. I wonder if part of their religious cultism is to have as many babies as they can so as to offset all the black and brown babies being born. More white elitism hidden behind the veil of religion.

Schlafly made a career, an organization and a boatload of money pointing out that this vile, filthy, disgusting proposal included the word "sex".
