It is an excuse used to justify the result they reverse-engineered. "I'm sorry, it's not my fault I ruled that way. Blame Madison."

Scalia once used the same rationale to come to two opposite conclusions. In the same week.

It's why Thomas doesn't talk during questions; he already knows the answer he wants.
