4. I agree paying is one issue.

Being able to complain might be more politically expedient than resolving the issue.

They also might want to delay until they can figure out if they need to be for recounts or against them. Not that being hypocritical is an issue for them, but some judge(s) might notice they are arguing in two different cases in a contradictory way and might call bs.
