What blows my mind is that Gohmert, who might be the dumbest member of Congress, has a law degree, was once a JAG and later a judge.

Gohmert attended the JAG School at the University of Virginia and entered U.S. Army JAG Corps. He served in the JAG Corps at Fort Benning, Georgia, from 1978-82.The majority of his legal service in the U.S. Army was as a defense attorney.... Gohmert was elected as a state district judge for Texas's 7th Judicial District, serving Smith County (Tyler, Texas) from 1992 to 2002. He was elected to three terms.

Look at Ben Carson, once a very respected surgeon (and medical school is even more daunting than law school), but as a cabinet secretary he gives the impression of being as dumb as a stump because he doesn't know anything outside of medicine and has chosen to remain ignorant of anything outside of medicine. I think it's possible to get an advanced education in a particular field and still remain stupid - by which I mean willfully ignorant, not developmentally disabled. Both Gohmert and Carson have intentionally allowed blind allegiance to their ideology to overshadow whatever basic intelligence they had that made it possible for them to get advanced degrees and work in a professional capacity.

Generally speaking you have to be able to dress yourself and walk upright to do those jobs, and I'm not sure Gohmert is even that smart. Or that he's read the Constitution and relevant statutes lately, if ever. The only function of the Vice President is to open the EC ballot certificates. He doesn't even count them himself; he just reads the results (3 USC § 15). This is consistent with the 12th Amendment, which says: "The President of the Senate shall, in the presence of the Senate and House of Representatives, open all the certificates and the votes shall then be counted." He's like the emcee at the Academy Awards. He opens the envelopes and reads the results. He doesn't get to decide who gets the Oscar.

Louie has sued Vice President Mike Pence. In court. Where lawyers hang out. No kidding.

This is all about the Vice President’s ceremonial role on January 6th, consisting of having the Congress count states’ electoral votes and finalize Joe Biden as the winner of the election.

But the Republican lawsuit, which was filed against Pence in his official capacity as vice president, asks a federal judge in Texas to strike down the law as unconstitutional. The GOP plaintiffs go further: They ask the court to grant Pence the authority on Jan. 6 to effectively overturn Trump’s defeat in key battleground states.

Now, not even getting into the constitutionality of this, think about what happens next – if this is the new law, then one party has the power to overturn every election from now to eternity because they’ll just keep appointing themselves after the election.

But, if you want to get into the constitutionality, we can do that. I’m pretty sure that the constitution does not allow the vice president to overturn an election. Pretty damn sure.
