President Biden, on his own, can launch Nukes if required but can't fire a Trump planted employee?

What kind of bizarre, down the rabbit hole and into the hall of mirrors, world do we live in? A president can destroy the world but has no power to fire a Federal employee whom the previous president placed as an enemy agent to hinder the presidents agenda. We even, in this era, have to consider it might be someone who would endanger whole nation due to their loyalty to Qanon, neo nazism, fascism or the Republican Party (how do you tell the difference anymore?).

Yes, except don't put the investigation on hold. lagomorph777 Jan 2021 #5

can be fired with cause, or if they got their appointments outside the competitive review/hiring process.

My guess is that a good number of the current 26 trump appointments we know about are going to be found as grossly incompetent in their current position, and/or that trump circumvented the competitive review process, so those shitbags will hopefully be losing their jobs in the weeks/months to come.

Biden’s staff will probably isolate trump’s plants from making decisions damaging to the Democratic Party agenda, and make their jobs a living hell. Maybe assign them to offices next to the coffee machine or restrooms.

He could be fired for cause, and there certainly is cause.

He can also resign. I think a federal criminal investigation of him for obstructing an election would be more than enough to get a resignation from him. He resigns; the investigation goes on hold.

Simple.

Keep him so busy dealing with the prosecutors, that it's impossible to stay in (or legally defend) his job.

there has to be some benefit to that person for resigning. Otherwise, why would they resign?

It's like plea bargaining, really. You get the skell to plead guilty to a lesser charge to avoid the cost and risk of a trial. The lesser charge has a lesser penalty. That's the bargain.

Most criminal cases never to to trial for that very reason.

They could also fire DeJoy for cause, but that will take considerable time, since federal civil service laws give the person a lot of time to dispute the issue.

It's all a matter of weighing the costs against the benefits, really. It's how it all works.

Maybe reduced jail time. Maybe strip his fortune to rebuild the machines he vandalized.

But he must pay a price.

First, you would have to prove mens rea. The defense would use the argument that the results of his changes were not expected, and that he reversed some of his decisions when untoward consequences were seen. They will claim that he intended no harm.

It would be a very difficult, and time-consuming prosecution.
