Sen. Josh Hawley on Monday filed a counter-complaint with the Senate Ethics Committee against the seven Senate Democrats who had previously filed a complaint against him and Sen. Ted Cruz over the two Republicans objections to the results of the 2020 presidential election.
The idea that one Senator who disagrees with another Senator can therefore have that Senator punished, sanctioned, censured, or removed is utterly antithetical to our democracy and the very idea of open, lawful debate, Hawley (R-Mo.) wrote in a letter to the seven Democrats.
Hawleys counter-complaint comes after Sen. Sheldon Whitehouse (D-R.I.) joined by Sens. Tim Kaine (D-Va.), Ron Wyden (D-Ore.), Tina Smith (D-Minn.), Richard Blumenthal (D-Conn.), Mazie Hirono (D-Hawaii) and Sherrod Brown (D-Ohio.) wrote to the Ethics committee last Thursday requesting an investigation of Hawley and Cruz (R-Texas), who led Republican efforts in the Senate to challenge President Joe Bidens Electoral College victory.
It was during Congress certification of Bidens win that a mob of pro-Trump rioters stormed the Capitol, breaching the buildings walls and temporarily halting the proceedings. Lawmakers were forced to shelter-in-place as both chambers went into lockdown, and at least five people died as a result of the violence including a Capitol police officer.

The Democratic senators said the question for the Senate to determine was not whether Cruz and Hawley had the right to object, but whether the senators failed to put loyalty "to the highest moral principles and to country above loyalty to persons, party or government department." They also said the investigation should determine whether Cruz, of Texas, and Hawley, of Missouri, engaged in "improper conduct reflecting on the Senate."

The Democratic senators said Cruz and Hawley announced their intentions to object, even though they knew that claims of election fraud were baseless and had led to threats of violence.
"Their actions lend credence to the insurrectionists' cause and set the stage for future violence. And both senators used their objections for political fundraising," the Democratic senators said in their letter.
