Can Trump be called as a witness in the Senate trial to be cross examined by the prosecution?

The bigger question is how to juggle Senators who are co-conspirators, should they be allowed to participate as jurors in a trial where they were participants in the crime?

(23,248 posts)has no application in impeachment, unless Senators vote to accept it. But, you're right, I don't think they could really force him to testify, or even show up.

(52,253 posts)Or some other non-criminal conduct, then yes, the 5th amendment doesn't protect him from incriminating himself.
But in this case, he's accused of doing something that is criminal -- inciting a riot, sedition, etc.
If they wanted to make him testify but not comment on those crimes, then yeah, the fifth doesn't apply.
But in this case, it would apply to any question of interest.
