There needs to be a national database so gun dealers can check the background of anyone wishing to purchase a firearm. The law allows for three days time for any background check. If they don't get a reply within those three days they're legally allowed to sell that firearm without that check being completed. That's just wrong. They should not be able to sell that weapon until a background check is completed. Always. Of course there are so many crooked gun dealers who'll disregard any and all laws, just because they want the money. Gun sales in this country are out of control. That needs to be reined in, immediately.

(6,627 posts)There is. It's called the NICS system: Nation Instant Criminal Check. The purchaser fills out Form 4473, and the information is relayed by phone or online to the FBI, which runs the prospective purchaser through its databases. Responses typically take minutes, not days. Mental health history is included only if there was an adjudication or involuntary confinement, which there apparently was, in this case. These purchases should have resulted in denial, as far as I can see. Insufficient or flawed reporting by local authorities is the most likely culprit for the failure.
The three-day provision is there to allay fears that, absent any impetus to complete background checks in a timely manner, the powers-that-be could halt all gun sales legally and immediately by simply halting the processing of the checks.

(32,912 posts)... prior to purchase of assault rifles. Not once but twice the background check FAILED to discover the fact that this young man should never be allowed to purchase a weapon.
1.) A shot gun that was previously legally owned was confiscated by police
2.) His own mother reported her son's questionable mental condition to police
3.) Local police had him on temporary mental health detention last year
4.) His frequent SMS activity included a website that is known to harbor rightwing hate groups
5.) Guy was fired from his job at Fedex for unknown reasons, and he'd only been working there for less than a year
Despite all of these red flags he purchased an assault rifle in July 2020 (passed background check) and another one in September 2020 (passed a 2nd time.)
I mean, are there any people who fail the background check?
Is anyone prevented from buying an assault rifle EVER?
Doesn't seem like it.
