TODAY AT THE COURT

On Tuesday, the court issued opinions in the following cases:

In Minerva Surgical v. Hologic, the justices held 5-4 that the patent doctrine of assignor estoppel is well grounded in centuries-old fairness principles, but it applies only when the patent assignor’s claim of invalidity contradicts explicit or implicit representations he made in assigning the patent.

In Johnson v. Guzman Chavez, the justices held 6-3 that 8 U.S.C. § 1231, not § 1226, governs the detention of aliens subject to reinstated orders of removal.

In PennEast Pipeline Co. v. New Jersey, the justices held 5-4 that a certificate of public convenience and necessity issued by the Federal Energy Regulatory Commission pursuant to Section 717f(h) of the Natural Gas Act authorizes a private company to condemn all necessary rights-of-way, whether owned by private parties or states.
