(Reuters) -Donald Trump's lawyers on Monday asked a federal judge to throw out a series of lawsuits by Democratic lawmakers and two police officers alleging that the former president incited the deadly Jan. 6, 2021, assault on the U.S. Capitol.
The three lawsuits, by Democratic U.S. representatives including Eric Swalwell and Jerry Nadler, as well as two Capitol Police officers who battled rioters claim that Trump is liable for injuries to police and lawmakers.
"The congressional Democrat plaintiffs are hoping this court will help them score points against a political rival at the expense of the Constitution," Trump lawyer Jesse Binnall said at the start of a court hearing.

The Democratic lawmakers have invoked an 1871 law passed to fight the white supremacist Ku Klux Klan that prohibits political intimidation.

"Let's stick with the facts," Mehta said, adding that he wasn't "interested" in "whataboutism."
He continued pressing Binnall on whether Trump's call for his supporters to march to the Capitol and his use of words like "fight" and "show strength," which were followed by Trump's supporters storming the Capitol, satisfied the standards required to establish conspiracy.
"No," Binnall said.
"So the president, in your view, is both immune to inciting the riot and failing to stop it?" Mehta asked.
