(115,683 posts)Just voting against releasing the documents raises eyebrows (and the court's order did not include a written dissent), but he could have come up with some lame legal argument which wouldn't have raised the question of a conflict of interest or the possible involvement of Ginni. Recusal, though, is rare at the Supreme Court and almost always involves a possible or actual conflict of interest - as when Rehnquist recused himself from deciding the Nixon tapes case because he'd worked in the White House in the OLC. So if Thomas had recused himself there would have been all sorts of entirely reasonable speculation about what the conflict could have been, and many fingers pointed at his wife, Mama MAGA.

Did Trump lawyers give cause that certain documents in particular not be released? For example, did they say Document 1 cannot be released because it contains information that would compromise security, or impugn innocent people, or whatever else they come up with?

(115,683 posts)which just makes people wonder that much more whether and to what extent he and/or Ginni were involved (we know Ginni signed a letter opposing the 1/6 Committee). He could have kept a low profile and voted for the release all the others voted for, even his new BFF Alito, since it was going to happen anyhow. Now everybody's wondering why. If he couldn't keep the documents under wraps, was he just trying to keep Ginni happy? Or TFG?

(15,643 posts)of Justice on the US Supreme Court. He has always been tainted. It would bring me great joy to see him impeached. Not likely, but I am keeping that hope alive at least as long as I am.
100 %, since the hearings before he was appointed.
