Employers received some long-awaited clarity on the Occupational Safety and Health Administration's mandate-or-testing rule last week, when the U.S. Supreme Court blocked its implementation.
While attorneys say many large employers were breathing a sigh of relief that they wouldn't have to comply with the Emergency Temporary Standard or its administrative burdens, many others have a decision to make.
Employment attorneys say a number of businesses that put in the legwork to create mandate-or-testing programs now must decide whether to proceed with their plans even though they no longer face potential federal penalties. Their decision will come against a backdrop of an Omicron-variant-fueled surge in Covid-19 cases that is severely affecting employers that were already in the midst of a challenging labor market.
Regardless of their plans for a mandate-or-testing program, experts say employers must continue to keep Covid-19 safety and potential OSHA implications in mind.

I freaking love it, and absolutely wish my employer would do the same thing, but at the moment, they're still sticking with the "deeply personal decision" meme regarding any employee's decision to vaccinate or not.

(7,413 posts)Vaccination is strongly recommended. Its a city/municipal government with 1000+ employees, exempt from OSHA jurisdiction so there werent any plans to mandate.
