If something were to happen during the confirmation process and Democrats lose the Senate, there's nothing to stop Breyer from staying on the Court.

The scuttlebutt is that he didn't want to resign, but was convinced to because of the risk that we could lose that seat down the line.

He isn't now. I think this retirement is probably talked about amongst president Biden along with the senators. They kind of know how they will vote or who they will vote for already. Of course, there is still a chance Manchin goes back on his word but I highly doubt it. He is better on judicial nominees than he is with voting rights or the BBB bill.

Nor is the news that he has announced that he IS retiring.

It's just a story saying that they have reason to believe that he WILL retire before the end of the term.

Biden can't nominate anyone yet.
