Constitutional law experts: Disney could 'absolutely' sue Florida for retaliation

On Friday, Gov. Ron DeSantis traveled to South Florida to sign, among other things, the bill that set into motion the dismantling of Disney’s 55-year-old Reedy Creek Improvement District.

“You’re going to marshal your economic might to attack the parents of my state,” he said. “We view that as a provocation, and we’re going to fight back against that.”

Elsewhere, the corporation’s lawyers may have been taking notes.

“Once the government provides a benefit, that benefit can’t be taken away in a way that is unconstitutional,” Lawrence Walters, managing partner of Longwood-based Walters Law Group said. “In other words, the government cannot retaliate against the company in response to the exercise of the company’s First Amendment rights.”

“Disney obviously has no right to have a business improvement district, but to take away something like that based on speech, that strikes me as highly likely to be unconstitutional,” said Daniel Greenwood, a law professor at Hofstra University in New York who specializes in corporate speech.

and if the gop is upset by that i would suggest they offer a constitutional amendment to undo citizens united. i'm sure they'll have no trouble getting Dems to go along with them.

Central Florida lawyers are a disgrace. They ramrodded bad lawyering into a populace that was out of control when it came to government process. When you have lawyers refusing to follow government process, and working behind the scenes to undermine the public, it only rattled those who didn't have any respect for the lawyers OR government process.

The public was hurt by this. We were denied good, affordable lawyers to defend us. And we certainly didn't have a local paper to set things right. Disney could force this state to shed the good ole boy ways, and come into the 21st Century.
