“The more that comes out on the arrests, the more I believe the individuals involved had no knowledge or intent to violate the law,’’ wrote Sen. Jeff Brandes, the Republican from St. Petersburg and Senate sponsor of the law that implemented the felons voting law, in a post on Twitter.

Because “the state has to prove intent,’’ he said he wonders: “Were these people ever notified that they were not eligible to vote? And can we prove that they did it willingly?

“The question comes down to: Where did this process break down to where voters got an actual voter registration card? In my opinion, it broke down in the Secretary of State’s office.”

make a law that creates a "program", in this case to verify voting eligibility, then not staff or fund it. They had 20 people in a office trying to review 87,000 applications... This is completely normal in FL government, we have tons of 'programs' with not even close to the necessary funding or staff in pretty much everything, everywhere.

These people got valid voter registration cards and were not removed from the rolls because of the backlog. They had every indication that they were legally registered to vote from the government on the day they voted. the DeSantis crew then comes back two years later to arrest them. There is obviously no intent to defraud here.

The Senate sponsor of the legislation that implemented the felons voting law has concluded “now a million dollar operation” of the Office of Elections Crimes and Security may ultimately produce no convictions.

▪ For the state to get a conviction for a third-degree felony for the crime of voting as an unqualified elector, it must prove that the people who voted illegally willfully intended to break the law.
▪ Of the 18 arrested so far, all told state investigators that they received a voter registration card from their county election supervisor’s office and believed they were authorized to vote by someone in government. According to the charging documents, some were told they were authorized to vote by multiple government officials.
