Assuming DOJ ultimately prevails, as they should, Trump will still get "access" to the documents

including, potentially, classified documents.

That doesn't mean the documents are delivered into his possession, but rather that he, or his designated representative, can review them. This will include classified documents to the extent the reviewing individual has the required level of security clearance.

The Archivist acknowledged this with respect to the January documents in the May 10 letter to Trump's lawyer.

"Please note that, in accordance with the PRA, 44 U.S.C. § 2205(3), the former President’s designated representatives can review the records, subject to obtaining the appropriate level of security clearance."

Trump does not have clearance and wont be able to get one.

During an August 11 conversation on Trump sycophant and serial misinformer John Solomon’s podcast, former Trump Department of Defense official Kash Patel said that he and Solomon both have “been on a mission” as “the president’s representatives to the National Archives” to prove Trump had declassified the documents seized by the FBI during its search of his residence at the Mar-a-Lago resort in Florida.

Both Solomon and Patel were named as Trump’s representatives to the National Archives in June, after the former president was subpoenaed by the FBI regarding documents allegedly taken from the Trump White House and kept at Mar-a-Lago.

She will choose one of his recommended masters. The DOJ appeal will not succeed.

This will go away slowly.

Another scandal will break about tfg that will eclipse this.

Rinse and repeat.

I will be ecstatic if I am wrong about this.

By this political ball game the Fascist-Society stooges are delaying this case.

The National Security of the United States of America should NEVER be played with in any circumstance!

Allied nations are seriously considering not sharing any of their intel with US for as long as the criminal menace will not be rotting in jail for all his crimes (the latest one being the more dangerous of them all yet), with no possibility to ever even RUN for the presidency AGAIN.

This includes records generated or received by Trump or his immediate staff. It will not include records generated or received by any other government agency.

10. Correct. If a document is subject to a FOIA request, its not a Presidential Record

But that won't include any classified information and there's been no suggestion from NARA that the documents it has seen so far included any agency records that don't qualify as presidential records.

But instead of following protocol and going through proper channels and abiding by Presidential Records Act, he felt he was above the law and entitled to keep everything wherever he wanted to unnaccounted for in unsafe locations.
