Now, he does not. And he never had the right to take them.

I hope the DOJ doesn't cave, and take one of his SM choices.

Even if they do take back both houses (please NO!) it’s still a crime issue. I don’t think Congress can do anything to change it.

Trump will never agree to a special master. Why should he, he has the investigation effectively shut down.

They said they planned to appeal Loose Cannon’s ruling. And so unless she decides to use some real law, that’s where this is going.

briefings that some former national security people and ex-presidents get. Plus, Biden had not extended executive privilege to him. Guess more details will come out. But, yes, it's a stalling tactic. Just gets so tiresome how he cannot go along with the same rules that everybody else follows.

WASHINGTON — President Biden said on Friday that he would bar his predecessor, Donald J. Trump, from receiving intelligence briefings traditionally given to former presidents, saying that Mr. Trump could not be trusted because of his “erratic behavior” even before the Jan. 6 attack on the Capitol.

The move was the first time that a former president had been cut out of the briefings, which are provided partly as a courtesy and partly for the moments when a sitting president reaches out for advice. Currently, the briefings are offered on a regular basis to Jimmy Carter, Bill Clinton, George W. Bush and Barack Obama.

Mr. Biden, speaking to Norah O’Donnell of CBS News, said Mr. Trump’s behavior worried him “unrelated to the insurrection” that gave rise to the second impeachment of Mr. Trump.

“I just think that there is no need for him to have the intelligence briefings,” Mr. Biden said.

It is traditional for certain people to "sustain" their clearances after departure. Not just Presidents by the by. And the truth is that I probably could have sustained mine if I had paid the price of a regular review. I'd also have been required to demonstrate the reason I needed it. And without some contract or other reason, I would have been denied. But presidents are eligible for regular secure briefings and so have a justification for maintaining their clearances.

But there are some limitations. All part of the Presidential Records Act.

But he has NO right to take them out of the Archives, much less never turn them over in the first place.

And He has NO absolute right to access any secret data.

The best way to tell a lie is to sprinkle a little truth in with the crap.

a security clearance to the proper level (along with any additional special access levels);

and

THE NEED TO KNOW.

The Manchurian Cantaloupe has NO need to know anything. He may or may not have an active security clearance, but he still has absolutely no need to know anything in those documents. He's not a part of the government, has no official duties, and therefore should have no access to any of these materials.

We all know it. Trump will NEVER agree. He’ll be negotiating for five years. No one should be stupid enough to assume that Trump is a good faith actor. He is NEVER a good faith actor.
