(6,689 posts)He's fat with power. He runs the Federalist Society and built the present Supreme Court. He was just given $1.6bln in not so dark money to continue building his 17th century kingdom.

(2,496 posts)(Im not a lawyer) that would move the case to D.C. and take it out of the 11th circuit. A new judge could make a separate determination.
Again, Im not a lawyer so Im just winging it here.

(15,611 posts)To prosecute the Espionage Act violations, as well as proving obstruction.
The documents turned over earlier could be prosecuted in DC under the PRA, but not likely obstruction or espionage.

(21,337 posts)the way it's going this will go on for months. may as well let Trump keep the documents and move on. I thought that DOJ would challenge the jurisdiction of this case also, too late now.
Fiendish Thingy
(15,611 posts)They couldnt appeal until Cannon had ruled- now they can appeal both the ruling and the jurisdiction.
We shall see tomorrow.

(7,432 posts)to the DC Court. Why the DOJ is fiddling with a tainted judge is something the marvel. They don't have to.

(2,496 posts)I think it would put the whole thing in a DC court.

(26,737 posts)The PRA does not direct cases "against the act" to the DC court.
It directs cases that arise as presidential (or former) appeals of decisions made by the archives re: the release of certain records.
But NARA hasn't received any requests to release documents - let alone made a decision on same - let alone had a former president disagree with that determination and bring suit.

(44,124 posts)Happily DOJ was already planning to appeal to the 11th circuit , they know what judge Cannon is.
Good piece from Emptywheel on her horrible ruling today:

(6,689 posts)The special master bullshit gives the media something to chew on. It is important, but the treasonous crime is tfg having them in the first place. We're waiting on his reason - other than "I needed the money" - which is looking like the winner at this point.

(21,337 posts)they claim they are stymied because they need to work with the FBI. This has nothing to do with media overreaction, it has to do with our national security.

(6,689 posts)This latest batch of documents, only after a search warrant, is the third batch the feds obtained. They were in the possession of the FBI for a couple of weeks before tfg's lackey judge said they needed another layer of supervision. They let the press know the number of secret documents and their level of classification the first week. The FBI might not be sharing the whole batch because of the court order. I can't imagine that the real sensitive/spy endangering stuff didn't hit Homeland Security immediately. The subpoenaed video of the room where tfg stashed all this stolen shit prompted the search warrant. What did the feds see on the video that made them quit acting nice? Treason crumbs leading to his lair? Let America know before the midterms.
Hit 'em straight tomorrow!

(7,432 posts)What he's seemingly not aware of is that Trump will lie to Hannity. In a heartbeat. If Hannity doesn't get his grubby mitts on the documents and read them with his own eyes, he won't know for sure, because Trump would NEVER tell anyone the truth about anything. There would always be a lie in his most sincere confessions, if any ever happens. It's an inexorable part of his narcissism. It's WHO HE IS.
Why doesn't Hannity know this?

(1,525 posts). . . appeal to the 11th Circuit? I assume they will and let's hope the Circuit applies good sense and facts and slaps down this Trump judge.
