Josh Marshall on the appeal

Josh Marshall
@joshtpm

Quite likely the appellate judges are as corrupt as Judge Cannon. But DOJ really needs to appeal this to the top just to not waste everyone’s time. If the corrupt federal judiciary has decided to create ex president exec priv to keep trump out of jail let’s get that into the open

Have you ever heard of, or even imagined, something as ridiculous as that?

This is exactly what the Federalist Society has been working toward for decades, and why McConnell stole TWO Supreme Court Justices.

The 11th is heavily red, so the question will be *which* of those judges will “randomly” be assigned.

Let's get it to the Supreme Court as soon as possible. I would not expect the Eleventh Circuit to vote any different than this Judge. They are assisting Trump in his delay of the process.

Let's send it to the Supreme Court and get it out in the open. Let the Court decide.

procedural appeal. I will believe until proven otherwise that even the judges in the 11th will rule in favor of the law which they understand better than Cannon.

We do indeed have FISA, but they are not military courts. Indeed… the selected special master was a FISA judge for several years.

FISA judges are part of the judicial branch and are selected by the SCOTUS Chief Justice

Is Cannon an incompetent judge making it up as she goes? Sure seems so. Is the entire 11th circuit corrupt? Come on, man. But that's what Marshall said in his tweet.

Consider, too, what some legal beagles have to say about Barr, Yoo and Christie criticizing Cannon's rulings, that they fly in the face of the legal theory that's at the heart of the Federalist Society - that of the Unitary Executive where all power rests with the sitting president. These Trump appointees weren't chosen by Trump, they were chosen by Leonard Leo and McConnell. Trump was just the vehicle used to nominate them.
