Cy Vance was on the case right? Until he wasn't. Or never actually was. I dont really know or understand wtf happened there, I can only speculate which I'm not inclined to waste time doing.

(2,193 posts)Did we "know beforehand". She is an AG she has the power/authority to call a grand jury and indict so she spent all this time investigating a "criminal" enterprise that was in fact breaking the law which she is supposed to enforce to end up with a civil lawsuit.
For me that amounts to disappointment... had I known that was it I would not have wasted my time watching it....

(2,193 posts)After thinking further on this I can see more reasons than just that to go the civil route, rules of evidence are a little looser and be easier to get a good jury for civil trial than criminal trial.

(4,616 posts)When the FEDS couldn't get him on anything else, they used what they could prove and Tax Fraud brought Al Capone down. And it was his accountant that drove the nail in his coffin. Sound familiar?

(4,616 posts)Public information for quite some time she was perusing a civil Tax Fraud case based on the laws of NY. She referred the Federal crimes to the US attorneys and the IRS, which falls under the DOJ as well. That's how it works. She's a state AG. She managed to shut down the Trump "charity" in a civil case. Where by the way the bar is not beyond a reasonable doubt, but a preponderance of the evidence.

His job but she can refer the case to him also...I will stay with going civil to have a better chance of favorable outcome.

James skirted around it before the acknowledged that he will be able to do these things.

I had a sense Aty General, wasn't able to gather or prewsent enough evidence which accurately encapsulated the full breadth of the fraudulent schemes he engaged in.
just intuiting... cuz it was a bit underwhelming in terms of the consequences or remedy sought.

(7,281 posts)I think the IRS has had the goods on this thug for a long time, but somehow he's managed to escaped levies on all of this accounts and estates.
My one hope is there are a number of criminal referrals we don't know about and was not mentioned in the presser. I'm hoping they're all carefully outlined in the 280 page complaint!

(19,060 posts)She did not have the ability to pursue her own criminal charges. Referring a criminal complaint to the DOJ is a massive deal and is more meaningful that $250M.
Basically giving the Trump family the corporate death penalty in NY, the state they all run their businesses out of is devastating.

(19,060 posts)That's not her role in this case because her investigation was a civil investigation. The nature of their probe was civil, if it had been criminal it would have required a grand jury to move forward. So she basically signed up for being limited to referring crimes to the DOJ for prosecution.
She did 100% of what she had the authority to do.

(14,966 posts)have done so previously. They didn't. So they probably won't. They had, or could have obtained, the evidence themselves long before now. They don't need the NY AG to do their job for them, they just need to do their job. Or not.
Making the criminal referrals was the right thing to do, but I don't expect anything from SDNY and the IRS beyond *wanking motion*.

They gave him and the family a pass for decades.
Why did Cy Vance not proceed with what they had?
Is Bragg gonna continue to delay or forgo prosecuting with all the evidence gathered from the concluded nvestigations?

(253 posts)She made it clear Trump will face repercussions from his fraudulent actions (lying about how much money he has, inflating property values, etc). Yes, she does have limitations since it is a civil suit but she made it clear he is 'not above the law' and basically strips their ability to make money in the State of New York. She named Don Jr, Eric and Ivanka as part of the fraudulent schemes and all of them will pay economically in one way or another. Do you think they will be able to get bank loans now? I would say highly unlikely. This certainly puts them under the microscope. I loved it! Thank you AG James!

In fact a reporter did ask a very important question. paraphrasing, the question she asked was "what will all this mean as a practical matter". what happens next?
