Special master Raymond Dearie had told Donald Trumps attorneys to address whether documents were, as Trump has claimed, planted or declassified
Judge Aileen M. Cannon told Donald Trumps lawyers Thursday that they did not need to comply with an order from special master Raymond J. Dearie and state in a court filing whether they believe FBI agents lied about documents seized from the former presidents Florida residence.
Thursdays ruling was the first clash between Cannon, a Trump appointee who has generally shown the former president deference in litigation over the Mar-a-Lago investigation, and Dearie, a federal judge she appointed as an outside expert in the case, who appears to be far more skeptical of Trump.
After Trumps lawyers requested a special master, Cannon chose Dearie to review approximately 11,000 documents seized Aug. 8 from Trumps Mar-a-Lago Club and residence and determine whether any should be shielded from investigators because of attorney-client or executive privilege.
An appeals court separately overruled Cannons decision that about 100 additional documents that the government says are classified some of them top-secret should be part of Dearies review.

In the meantime Dearie will probably give them hell in another way.

(5,125 posts)Explain that accusations have been made and not substantiated and that she is preventing the Special Master from doing the job that was given to him BY THE tRUMP team.
IF they believe anything was planted, this is their opportunity to clear that up.
OR... so therefore if there is NO RESPONSE, the only assumption is that everything under review is clearly exactly whatever it appears to be as they refuse to give any special instruction in an actual court filing.
Actually, CANNON really doesn't have any power in the long run.
Dearie can just agree with the the previous review and NOT FIND ANY ISSUE of items needing to be shielded beyond those already identified.

(44,120 posts)to the DOJ in their last ruling that they think Cannon is a ignorant hack. I cant imagine they will like that Cannon is allowing Trump to get away with lying about the FBI planting evidence.

(2,945 posts)order of finality declaring that his authority has been hamstrung by Cannon rendering no need for his services? Would this force Cannon to rule more quickly on the 11,000 docs?
Question: does the original SM order hand over all authority to the SM during the doc review process and reserve her authority to issues after she has reviewed the SM report? If so, wouldn't Cannon's interference be appealable?

(44,120 posts)I expect DOJ was well prepared for her to do something like this.
Obviously not a lawyer here, but I dont think the 11th Circuit, DOJ, and Dearie are going to play her games.
