South Dakota Gov. Noem threatens charges for abortion pills

PIERRE, S.D. — South Dakota Gov. Kristi Noem, along with the state's Republican attorney general, said Tuesday the state will prosecute pharmacists who dispense abortion-inducing pills following a recent Food and Drug Administration rule change that broadens access to the pills.

The Republican governor and South Dakota Attorney General Marty Jackley released a letter to South Dakota pharmacists saying they are "subject to felony prosecution" if they procure or dispense abortion-inducing drugs. The state bans all abortions except to save the life of the pregnant person.

"South Dakota will continue to enforce all laws including those that respect and protect the lives of the unborn," Noem and Jackley said in the letter.

The FDA earlier this month formally updated labeling for abortion pills to allow many more retail pharmacies to dispense them, so long as they complete a certification process.

The change could expand access at online pharmacies. People can get a prescription via telehealth consultation with a health professional and then receive the pills through the mail, where permitted by law.

Still, in states like South Dakota, the rule change's impact has been blunted by laws limiting abortion broadly and the pills specifically. Legal experts foresee years of court battles over access to the pills as abortion-rights proponents bring test cases to challenge state restrictions.

The anti-choice understanding of the issue is Binary. In black-or-white world, there is no moral difference between the morning-after pill and a late-term abortion.

Pharmacists will comply. Women will soon have to travel out of state to have a prescription filled. MN will be the destination; I have no idea what NE or IA's abortion-access laws are - probably just as regressive as SD.

If you're in Sioux Falls, you'll be able to get around it. If you're in Rapid City you're probably fucked - unless you use an out-of-state pharmacy to ship to you?

.... abortion or liked to have sex with your boyfriend watching? Say what? That this is none of my business well
the same thing goes for any woman in S. Dakota as per her own family planning and sex life.

Why would any woman vote republican?

If those pills are used for other treatment purposes then it seems there would be grounds to overturn any law banning their use. There is also the question of whether SD has the authority to inspect any parcels being delivered by the USPS to SD residents. As a retired letter carrier, I never heard of or saw anyone other than a Federal law enforcement with proper documentation be able to open a package for inspection.
