So many questions...
It was not normal that his car was stopped IN the street and not pulled over to the side.
Why yank him from the car vs asking for a drivers license and give him a ticket?
This whole thing is rotten!
I can't imagine my own terror and confusion to be pulled over, in the street, and yanked from my car for no reason.
And for a beating to ensue. Tyre never was told what was going on.
If anyone has more information, please share.

Police have to be threatened in order to justify ordering a driver and/or passenger out of the vehicle.
I've had my share of tickets. I try not to engage with the officer, save for removing sunglasses, keeping my hands visible on the wheel, and advising that I'm going to open the glove compartment to get the insurance card.
Common sense means reading the officer and not escalating the situation.
Tyre seemed compliant and respectful on tape.
My theory is the cops thought he was someone else and intended to whoop ass.

Soooo many questions! I am concerned that 2nd degree murder might not be the right charge and they get off.
How about adding manslaughter?
I used to get pulled over for speeding. It was always to the side of the road, the cop said what it was for, and asked for my ID.
That is the normal way of doing a pull over. I'm so sorry Tyre went through this.

When you get a bunch of angry cops, they act first and don't ask questions.

(17,865 posts)That is murder two. I assume they will have the lesser included manslaughter in the jury instructions, but they intended to hurt him (which is a crime) and that violence led to his death. How can it be anything other than murder 2?
Voluntary Manslaughter:
Voluntary manslaughter is the intentional or knowing killing of another in a state of passion produced by adequate provocation sufficient to lead a reasonable person to act in an irrational manner.
What reasonable person would hold him up and continue to hit him?
I assume the Feds will also bring charges for the 4th amendment violations under color of law.
Section 242 of Title 18 makes it a crime for a person acting under color of any law to willfully deprive a person of a right or privilege protected by the Constitution or laws of the United States.
For the purpose of Section 242, acts under "color of law" include acts not only done by federal, state, or local officials within their lawful authority, but also acts done beyond the bounds of that official's lawful authority, if the acts are done while the official is purporting to or pretending to act in the performance of his/her official duties. Persons acting under color of law within the meaning of this statute include police officers, prisons guards and other law enforcement officials, as well as judges, care providers in public health facilities, and others who are acting as public officials. It is not necessary that the crime be motivated by animus toward the race, color, religion, sex, handicap, familial status or national origin of the victim.
The offense is punishable by a range of imprisonment up to a life term, or the death penalty, depending upon the circumstances of the crime, and the resulting injury, if any.

Like the OP said, the usual protocol wasnt followed for the stop, almost as though he was a person they were looking for on an APB.
Or a guy they were mad at for reasons.

(17,865 posts)Tennessee is a death penalty state and everyone involved with the plot to teach him a lesson is guilty of 1st degree murder.
There are also federal civil rights implications because they intentionally violated his 4th amendment rights.

Sir Maejor, an actor and model, tweeted on Monday: "I am being told that Tyre Nichols was in a relationship with and worked at a Memphis FedEx with Memphis Police Demetrius Halys's ex-girlfriend & baby mama. After the beating Officer Halys took a pictures of Tyre Nichols' face and sent it to his babymama."
He qualified soon after that tweet, which has been viewed nearly 60,000 times, the assertions were "merely speculations" and the information "has not been confirmed."
Meanwhile, Lisa Campbell, a Washington D.C.-based "life advisor", said she was "being told" that the alleged beating "was personal" and that Nichols was sleeping with Haley's wife, in a post that has been viewed more than 2,000 times. In another post, viewed nearly 1,500 times, she claimed the wife had "reported this to the police."

(17,865 posts)allegedly saw the reckless driving which was the probable cause for the stop. That same report also includes lies regarding what happened later (the description did not match the video) so how reliable is this officer. The first video starts with him already blocked in. Was he attempting to flee before this happened? Fleeing or warrants would be the only reason for a felony stop (gun drawn and immediate hands on).
There are some theories on the internet (take them with a grain of salt).
1. He was romantically involved with the girlfriend/wife of one of the cops and this was going to be a lesson (if this is a case then the whole thing rises to first degree murder for anyone involved with the plot). [Tyre's family member has denied that this happened, and would trust their word over some vague rumors so this theory is highly unlikely].
2. They thought he was someone else. Because they haven't destroyed his character yet, this also can be likely. He generally seems like he was a really nice guy. Of course who he is is irrelevant in how he was to be treated. It still would be murder if he was a vicious criminal. He is a lot like Elijah McClain in this respect.

(13 posts)This has not been confirmed; but Ive read this on more than one site; that would be that Tyre worked with one of the cops exes. I read that that cop took pics and sent to his ex during the stop. Again, this has not been confirmed. It would, however, explain why Tyre was treated so rough and beat to death.

(25,270 posts)Out of respect for Tyre & his mourning family - I kept my thoughts to myself.
It almost looked liked these cops were laying for him. The beating looked personal.
It will be interesting to see if there was any connection between Tyre and the cops before this incident took place.
