Barbara McQuade, a University of Michigan law professor and a former U.S. attorney said that subpoenaing Pence to testify under oath is a key step for prosecutors, while also setting up yet another showdown with regard to executive privilege.
"It signals that DOJ is seriously considering criminal charges against Trump for January 6," McQuade told Newsweek. "While it does not mean charges are a certainty, DOJ would not take such a significant step as subpoenaing a former VP if they thought the case was unlikely to result in charges."It also suggests that charges are close. Prosecutors typically question the top witnesses at the end of the investigation after they have learned as much as they can about the facts."
Pres. Biden has already declined to invoke executive privilege after a number of Trump allies, including former White House adviser Steve Bannon and ex-White House trade adviser Peter Navarro refused to comply with their subpoenas issued to them by the House Select Committee investigating the January 6 attack.
"Biden will decline, I am sure, and if it goes to court, I think Trump will lose based on the court's earlier decision that Trump could not use executive privilege to block the National Archives from producing documents to the Jan 6 Committee," McQuade said.

In this case Barb McQuade notes the subpoena of the VP at this stage in the investigation, of a high profile target or subject, signals the end game in this process.
Comparing this attorney's view about a progressing investigation, complete with two separate grand juries hearing testimony and viewing evidence, to MAGA is some really off the wall shit.

I think the issue Rachel raised re the attack that will come if an indictment is brought will cause Garland to pass.

Supposing that Garland will 'pass' in the end, no matter what is a convenient way to dismiss actual progress. There's no evidence that Garland has ever been intimidated out of acting due to fears about supremacist violence.

Barb makes a good point. You don't come for the high profile witnesses until you cover all of their underlings. It just makes sense.

The two grand juries are still assembled, hearing testimony and viewing evidence. Aside from the dubious value in leaping past the very bodies assembled to give legitimacy to their investigation, the entities which the federal justice system uses to make official determinations of probable cause, what other process is there to an indictment?
No prosecutor worth a damn runs investigations like a shoe slogan.
