This is the way I see it.
The cup of the Special Counsel runneth over. He has more cases than he can handle at one time. That is why he needs to stagger them in order to present all the evidence.
It does appear that Jack Smith wants to finish the Mar-a-Lago investigation first. He has questioned Trump's lawyers that are involved in that case. He is invoking the crime-fraud exception against Evan Corcoran, Trump's primary lawyer.
The January 6th investigation is more complex and will take more time. By subpoenaing Mike Pence, he was able to get Pence to show his hand. He was able to get Pence to say that he was going to fight the subpoena and how he was going to do it. Thank you, Mr Vice-President!
This will, in effect, permit Jack Smith to continue his aggressive investigation of the Mar-a-Lago crimes and have a head start when he begins his January 6th investigation in earnest. Pence was too smart by half. He gave away his strategy.
However, both of these investigations will probably wait until it is seen which direction the GA investigation is going with DA Fani Willis. She should have a new Grand Jury in about a month and if it does not go the way the DOJ and the Special Counsel wish, then indictments will start falling quickly in the Mar-a-Lago crimes.
Mike Pence will be cooling his heels and talking to his lawyers but he has already shown his cards.

(21,402 posts)He knew the executive privilege excuse had already been tossed out. According to Zoe Lofgren tonight, this was an unexpected excuse that was devised by Pence's lawyers, it most likely won't hold water but it will delay more so than an executive privilege excuse would have.
Jack Smith is capable of handling both criminal investigations at once.

(111,110 posts)For some reason, he thought Mike Pence would not be there on January 6th to count the Electoral votes and that he would be the one to do it. He later changed his story. But why would he say such a thing??
Some prefer to assign the best of motives to Mike Pence because he came back later to count the votes but we do not know for sure if that was part of the plan? He may have been part of the conspiracy all along?

They shall in all Cases, except Treason, Felony and Breach of the Peace, be privileged from Arrest during their Attendance at the Session of their respective Houses, and in going to and returning from the same; and for any Speech or Debate in either House, they shall not be questioned in any other Place.

The highlighted passage refers to speech and debate in the houses of Congress, not in the WH.
I dont see how he could claim the Speech and Debate defense for conversations in the WH
..

I think we may have read it wrong? I think he may have known about the full conspiracy all along and remained silent?
